On Monday, 21st March, the Traffic Law reform came into force aimed at reinforcing road safety and reducing the accident rate. Among the changes, there is a greater licence points withdrawal for those who drive while holding a phone in their hand. Now 6 points will be deducted instead of 3, in an attempt to reduce distractions at the wheel, which are the main cause of accidents with victims.
Failure to use seat belts, child restraint systems and other protective equipment such as helmets will result in the loss of 4 four points, up from the current 3.
Bicycles and scooters
A series of measures for bicycles and scooters will also come into force to improve the safety of both users and pedestrians, as the new state regulation definitively removes personal mobility vehicles from pavements. Therefore, they will have to circulate on bicycle lanes or, failing that, on the road. They are prohibited from riding on motorways or highways.
The use of helmets will become compulsory when riding a scooter or any other personal mobility vehicle. As for bicycles, the requirement to wear a helmet on interurban roads is maintained, while in cities it is only compulsory for those under 16.
In view of the proliferation of the use of bicycles and electric scooters among minors, a zero alcohol limit is established for them as drivers of any vehicle. The general rule limit is 0.5 grams of alcohol per litre of blood or 0.25 milligrams per litre of exhaled air, for minors, it is 0.0.
Driving licence and points balance
The system for recovering driving licence points remains unchanged, but the deadlines have changed. Regardless of the offences committed, the period for recovering the initial balance of 12 points is unified in two years, provided that no new offences are committed that deduct points during that time. Until now, the period ranged from two to three years, depending on the penalty's seriousness.
In administrative matters, it is no longer necessary to physically carry the driving licence, and it can be accredited through the 'miDGT' App.
