Last December, the ordinance update was approved, which included a series of modifications, particularly the Mijas Town Hall's approval of the terrace enclosures policy. Currently, there are 190 terraces occupying space on the public highway. "There is an increasing request for terrace enclosures to adapt this area, where bars and restaurants are working, preferably after the pandemic. We saw the need to allow more possibilities to those who request it", justified the change, the Councillor for Public Roads, who added that "the establishments are looking for open spaces or, at least outdoors. We understand that with good criteria, they want to provide these outdoor terraces with enclosures and to improve".
Thus, now these licences will be carried out taking into account the public interest such as "job creation, tourist attraction or aesthetic improvement of the space," said Cruz.
The first step is to present the project, request the building permit from the Town Planning Department, or a responsible declaration. "If the enclosure project has a roof, it will be necessary to go a step further, and a technical project will have to be presented. Otherwise, a scale sketch and detailed information on the dimensions and materials to be installed will be more than enough for the Town Planning technician to assess and grant the licence", said Cruz, who pointed out that "always with flexible, folding and transparent materials, something that remains unchanged".
These requests, the Councillor pointed out, will be studied on a case-by-case basis: "It will depend on criteria of accessibility, aesthetics and decoration, town planning criteria in terms of the classification of the land, and traffic reasons". Cruz also warned that "it could be the case that there are several establishments in the same area, that some have authorisation and others do not, depending on these criteria".
If in doubt of the granting permit viability, a technical commission will be set up, from Public Roads technicians, Town Planning, Local Police, and Industry. "They will deal and try to find a solution to any case that cannot be included in the ordinance", said Cruz.
These modifications to the Public Roads Ordinance came into force on the 14th of April and include the updating of 17 of its articles.
