At the very last minute, the mortgage eviction that weighed on a family in the Riviera del Sol Urbanisation has been temporarily resolved, which, finally, has been suspended for at least one month. Scheduled for ten o'clock this morning, the Malaga Platform for People Affected by Mortgages (PAH) has mediated to prevent a family with three minor children from being left on the street.
The problems of Juan José Campos and Sara Rodríguez, those affected by the eviction order, began when Juan José was involved in a traffic accident nearly a decade ago that prevented him from working and caused a delay in the payment of their mortgage. At that time, the bank implemented an early expiration clause that led to a judicial procedure with an eviction order that has been paralyzed.
In the words of Campos: “I was in the hospital for five months, during which time I was unable to work or pay, but although those late payments were covered, the bank enforced the early due date. When I realized this, my house was no longer mine and I did not even have the right to pay for it because it now belonged to the bank”, after learning, with relief, that he will be able to continue fighting for his home.
This has been made possible thanks to the involvement of numerous people and groups such as the PAH. In this regard, Mónica Pérez, spokesperson for the platform, wanted to thank all those involved, “above all, lawyers María Palma and Manuel Arana, who have been collaborating with us closely and thanks to whom we have been able to stop the eviction at the last minute by submitting a preliminary ruling. Many thanks to them and to all the groups that have accompanied us from Mijas and to STOP Evictions, of course”.

The councillor in opposition, Esperanza Jiménez (Podemos) also attended the rally, which took place at the doors of the home of those affected, and assured that the stoppage of the eviction is "good news, but such unpleasant situations in which a family is about to lose their home when they cannot afford to pay must not be allowed in Mijas. It cannot be allowed in the situation we are in. Everything that the family and their neighbours have gone through is absolutely unfair”.
The appeal arrived minutes before 10 in the morning, the scheduled time for the eviction, and allows this family, who have a baby girl born only 17 days ago, a month’s extension to continue demanding what they consider fair. Meanwhile, for its part, the PAH has assured that it will sue the bank for abusive clauses in the contract. The demonstration was attended by about thirty people, among whom was also the local coordinator of IU, Antonio Fortes.
From the Social Services Council of the Town Hall, they assure that they are closely following the case of this family, as well as those of others in vulnerable situations. The department reported that the family has received the family financial aid at least once and that another administrative process is being processed to which they could benefit, and explains that they have contacted the family's lawyers to inquire about the situation. The Council has also indicated that they already had foreseen a provisional housing alternative in the event that the eviction had occurred.
