The Local Government Board of the Mijas Town Hall has approved the transfer of municipal land to the Junta de Andalucía for the expansion of the Jardín Botánico nursery and primary school in La Cala. The land comprises two plots zoned for public facilities, totalling 9,052 square metres, which are being made available to the Regional Ministry of Educational Development and Vocational Training.
Jardín Botánico is attended by 520 students aged between 3 and 12, from the first year of nursery school through to the sixth year of primary school. At present, the school occupies a plot within a block that is completed by the other two plots now being transferred, as well as a shopping and dining area. Once the Regional Government of Andalusia officially accepts the transfer of the land, the required agreement between both institutions will be signed.
According to the local Executive, “this transfer process began under the current administration in November 2023, with the corresponding administrative order”. Following the processing of all the required reports (patrimony, topography, architecture, infrastructure and public consultation), final approval was granted by the Local Government Board, the local government explained.
Institutional cooperation
The government team explains that, under the Andalusian Local Autonomy Act (LAULA), local councils are responsible for cooperating with the regional education authority. Specifically, the law states that local authorities have jurisdiction over the upkeep, maintenance and security of buildings used for the second cycle of nursery education, primary education and special education, as well as for making the necessary land available to the education authority for the construction of new public schools.
