46 people under investigation for offences against territorial planning in the province

In the operation, 30 urban planning offences have been clarified on rural land and 192 complaints have been filed for town planning infractions

Agents belonging to the Nature Protection Service (Seprona) of the Command of the Civil Guard of Malaga, under the direction and coordination of the Environmental Prosecutor's Office of Malaga, have carried out the so-called Murus operation, which has been developed during the year 2023 in the province of Malaga. The Guardia Civil point out that this operation was initiated "with the aim of combating attacks against territorial planning and town planning, to protect the environment, historical and artistic heritage and the landscape, as well as to guarantee sustainable and balanced urban development in the province of Malaga".

The investigation has counted on the collaboration of the Inspection Services of the Ministry of Development, Infrastructures and Territorial Planning of the Andalusian Regional Government, as well as the Technical Services of the local councils involved, which have certified the classification of the land and the illegality of the constructions and buildings.

Seprona has carried out 179 inspections in all the counties of the province, detecting 192 administrative infringements, mainly for lack of planning permission, failure to comply with the project and/or the licence, earthworks, etc. All the complaints have been sent to the respective town halls, which are responsible for territorial and town planning discipline.

Of the actions carried out against the land, the following stand out, among others: the illegal construction of single-family houses on rural land, in some cases in protected areas, the illegal installation of prefabricated houses for residential purposes, the construction of swimming pools masquerading as irrigation pools, the construction of barbecues for recreational purposes without justification or the construction of tool sheds and their subsequent change of use into a residential dwelling.

The agents observed the alleged commission of 30 urban planning offences in the towns of Ronda, Mijas, Ojén, Casares, Estepona, Manilva, Coín, Pizarra, Alhaurín el Grande, Alhaurín de la Torre, Álora, Alozaina, Canillas de Aceituno, Rincón de la Victoria, Tolox, Competa and Torremolinos. The proceedings for these offences have been sent to the Environmental Prosecutor's Office in Malaga.
