Juan Carlos Maldonado becomes a non-attached councillor at the Mijas Town Hall

The ordinary plenary session corresponding to the month of October has left behind a significant change within the municipal corporation, the change of Juan Carlos Maldonado, until now councillor for Por Mi Pueblo, to non-attached councillor. Under item 3 of the agenda, the session was held to acknowledge the councillor's new status, an issue that has been on the table since the plenary session of the 23rd of June, when Maldonado himself requested his withdrawal as he did not agree with his party's decision to expel him following the government agreement reached with PSOE and Cs. 

Under article 92 of the Regulation of Organisation, Functioning and Legal Regime of Local Entities, the PP's second deputy spokesman, Mario Bravo, asked the plenary session to leave the item on the table, arguing that "the accompanying report was drafted before the presentation of the letter from Por Mi Pueblo last Monday". A letter that the party presented to the Town Hall in which it reported the membership of Juan Carlos Maldonado in the party and in which it requested, therefore, the archiving of the processing of Maldonado's change of status to non-attached councillor. "If there is no expulsion, there is no cause and, therefore, there can be no effect, among others, the passage of the councillor to the status of non-attached councillor", explained Bravo, while he has asked both the Secretariat and the legal advice of the Town Hall "to be informed about the consequences of the letter presented on Monday". 

The municipal secretary, José Manuel Páez, then took the floor to inform the meeting of the content of article 92 of these regulations. In effect, according to the text, "any councillor may request, during the debate, the withdrawal of a file included on the agenda, so that documents or reports can be incorporated into the same, and also that the file remains on the table, postponing its discussion to the next session". However, Páez pointed out that "this precept is not applicable to a reasoned decision such as the one presented to us in this case". This argument was supported by the mayor of Mijas, Josele González (PSOE). "It has been made clear that we are dealing with an acknowledgement, not a proposed agreement, which has been dealt with almost since the constitution of this corporation. In this regard, the mayor reported that "there are many written documents, as well as a report by the secretary explaining Maldonado's situation. In addition, there is a letter signed by the nine councillors of the PP in which they ask for the secretary's pronouncement regarding this situation and in which they understand that he should become a non-attached councillor from the 16th of June". 

Termination of duties
In item 6 of the agenda, the plenary session was also informed of the decree by which Juan Carlos Maldonado was dismissed as a member of the Local Government Board and second deputy mayor. Likewise, as a result of his status as non-attached, the councillor loses his exclusive dedication as well as the delegations he has held until now: Economic Development, Employment Promotion, Commerce, Agriculture and Livestock, Hunting and Fishing and Pets. In this way, he would not receive the salary of a councillor in the government team, receiving remuneration only for attendance at plenary sessions and informative commissions. 

No-confidence motion
Maldonado ceases to represent Por Mi Pueblo in the Mijas Town Hall following the no-confidence motion registered on October 18th by the Partido Popular and Vox which, with the support of the councillor, aims to oust Josele Gónzalez from the mayor's office, proposing Partido Popular's Ana Mata as mayoress. This motion will be voted on in the extraordinary plenary session which has been called for November 2nd at 12 noon and which will be broadcast live by Mijas Comunicación. 

Maldonado's disagreements with the party he headed at local level in the last municipal elections began in June, following the governability agreement reached with PSOE and Ciudadanos. After weeks of negotiations, the councillor decided to support this bloc, leaving PP and Vox, who also needed one councillor to obtain an absolute majority and form a government, in the opposition. This agreement led Por Mi Pueblo to register a letter with the Town Hall requesting that he become a non-attached councillor. A matter which, as the municipal secretary specified in a report, required the approval of the Plenary Session in order to be put into effect, and which was therefore included in the agenda of the session on June 23rd, remaining on the table at the request of Maldonado himself. 

The decision of Por Mi Pueblo, once the no-confidence motion had been registered, to halt the procedures to grant Maldonado the status of non-attached member by means of a written document on Monday has not taken effect. Next week the municipal corporation has another date, in this case, to vote on the no-confidence motion.
